2. Publication director

The publication director of the Site is Mr. Mohamed Amine Dhouibi, in his capacity as Manager of the DEEPIC company.

3. Hosting of the site

In accordance with the directives of the National Authority for the Protection of Personal Data (INPDP) and Organic Law No. 2004-63 of 27 July 2004, personal and health data are hosted by default on secure servers.

4. Purpose of the site

The Site presents the DEEPIC platform and, for Users with an account, provides access to the Service for the secure sharing of medical documents and health data (CT scans, MRIs, reports, laboratory results, prescriptions, etc.) between patients, healthcare professionals and healthcare establishments.

Access to and use of the Service are governed by the DEEPIC policies available on the Site, which prevail for any question relating to the conclusion, performance or termination of the contract between DEEPIC and the User.

5. Intellectual property

All the elements composing the Site (structure, design, texts, logos, trademarks, databases, software, interfaces) are the exclusive property of DEEPIC or its licensors, and are protected by Tunisian literary and artistic property law and industrial property law, as well as, where applicable, by the international conventions administered by the World Intellectual Property Organization (WIPO), in particular the Paris Convention and the Berne Convention.

Any reproduction, representation, modification, publication or adaptation of all or part of the elements of the Site, by any means whatsoever, without the prior written authorisation of DEEPIC, is strictly prohibited and may constitute the offence of counterfeiting.

6. Personal data and cookies

The processing of personal data, and in particular health data, collected via the Site and the Service is described in the DEEPIC Privacy and Personal Data Protection Policy. The use of cookies and similar technologies is described in the DEEPIC Cookie Policy. These documents, available on the Site, form an integral part of these legal notices.

In accordance with Organic Law No. 2004-63 of 27 July 2004 and, where applicable, the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679), any User has a right of access, rectification, objection, erasure and withdrawal of consent concerning his or her personal data, which he or she may exercise by contacting the DEEPIC data protection officer at dpd@DEEPIC.net.

7. Limitation of liability

DEEPIC implements all reasonable means to ensure the accuracy and currency of the information published on the Site, without however being able to guarantee its completeness or the absence of errors. DEEPIC may not be held liable for direct or indirect damages resulting from access to the Site, its temporary unavailability, or the use made of it, subject to the applicable mandatory provisions.

The Site may contain links to third-party sites. DEEPIC exercises no control over these sites and declines all responsibility for their content or their data protection practices.

8. Applicable law and competent jurisdiction

These legal notices are subject to Tunisian law. Any dispute relating to their interpretation or performance falls, in the absence of an amicable resolution, within the exclusive jurisdiction of the courts of Sousse, Tunisia, subject to the public policy provisions applicable to Users having the status of consumers.
